The law has recently been changed regarding the repayment of VAT. As a purchaser of freehold property held through a fully managed leaseback rental scheme you are allowed to reclaim the full 19.6% VAT refund that is applicable to new build properties. Under earlier legislation,if you sold within 20 years then you had to pay a proportionate amount of the VAT back to the tax authorities. This is no longer the case. The French tax code has been changed and it is now possible to sell a leaseback property without repaying the proportionate VAT when a leaseback agreement is carried on by the new owner of the property.
